On February 8, 2017, Brazil requested consultations with Canada with respect to measures concerning trade in commercial aircraft.

Brazil claimed that the measures appear to be inconsistent with:

  • Articles 3.1(a), 3.1(b), 3.2, 5(c), 6.3(a), 6.3(b), 6.3(c), 6.4, and 6.5 of the SCM Agreement.

On February 23, 2017, Japan requested to join the consultations.  On February 24, 2017, the United States and the European Union requested to join the consultations.  Canada informed the DSB that it had accepted the requests of the European Union, Japan, and the United States to join the consultations.

On August 18, 2017, Brazil requested the establishment of a panel.  At its meeting on August 31, 2017, the DSB deferred the establishment of a panel.  At its meeting on September 29, 2017, the DSB established a panel.  The United States, China, the European Union, Japan, Russia, and Singapore reserved their third-party rights.

On January 29, 2018, Brazil requested the Director-General to compose the panel.  On February 6, 2018, the Deputy Director-General, acting in place of the Director-General, composed the panel.
