On September 9, 2016, India requested consultations with the United States regarding certain measures of the United States instituted at the state and local level relating to alleged domestic content requirements and subsidies in the energy sector.
India claimed that the measures appeared to be inconsistent with:
• Articles III:4 and XVI:4 of the GATT 1994;
• Article 2.1 of the TRIMS Agreement; and
• Articles 3.1(b), 3.2, 5(a), 5(c), 6.3(a), 6.3(c), and 25 of the SCM Agreement.
On January 17, 2017, India requested the establishment of a panel. At its meeting on February 20, 2017, the DSB deferred the establishment of a panel. At its meeting on March 21, 2017, the DSB established a panel. Brazil, China, the European Union, Indonesia, Japan, Korea, Norway, Russia, Saudi Arabia, Singapore, Chinese Taipei, and Turkey reserved their third-party rights.
On April 11, 2018, India requested the Director-General to compose the panel. On April 24, 2018, the Director-General composed the panel.
