Chapter 31 Disputes

USMCA Chapter 31 (Dispute Settlement) establishes procedures for monitoring and enforcement of the modernized, high-standards rules of USMCA.  Under the USMCA’s revised dispute settlement procedures, the panel is established upon delivery of the request (Article 31.6.4).  
In 2020, the United States pursued its first action under USMCA Chapter 31.  In December 2020, the United States requested consultations with Canada regarding Canada’s administration of 14 of its dairy tariff-rate quotas (TRQs) that deny the ability of U.S. dairy farmers, workers, and exporters to utilize the TRQs and realize the full benefit of the USMCA.
